This article addresses the human right to a healthy environment which, despite not being new, has long been violated, but now, due to the serious consequences of climate change, it has been retaken by Emerging Human Rights to expand its coverage and urge its punctual compliance, in order to channel decisions and actions in favor of genuine environmental protection.
This right is analyzed in a conceptual and application way, in order to demonstrate that there is a reinterpretation of this human right, concluding that citizens, based on a legitimate interest, can claim its effective compliance, as it was in the case of the “Laguna del Carpintero Ecological Theme Park” project in Tampico, Tamaulipas.
